The terms “we”, “us”, Site, “our” or “Kill-Shot Pro” refer to Kill-Shot Pro, a division of Eureka Technology Partners, LLC. “you” or “buyer”, refer to the party having accessed this website and/or purchased products or services from us. This describes our policies regarding the Limited Warranty of products we sell to you.

We warrant the sold products against defects in materials and workmanship under normal use and service for 90 days provided it is returned in accordance with our Shipping and Return Policies. You can refer to these policies by visiting the links provided in the right hand column of this page.

This warranty does not cover defects or damage resulting from: misuse, improper operation, unauthorized modification, or normal wear and tear.

WE WILL NOT BE LIABLE FOR DAMAGES IN EXCESS OF THE PURCHASE PRICE OF THE PRODUCT FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE SUCH PRODUCT, TO THE FULL EXTENT SUCH MAY BE DISCLAIMED BY LAW. THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED TO THE DURATION OF THIS LIMITED WARRANTY. HOWEVER, SOME STATES DO NOT ALLOW LIMITATIONS ON INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR LIMITATION ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

The Kill-Shot Pro™ products are designed and manufactured with the intended use as a pickleball training system. The Product is a supplement to the normal precautions a reasonable person would take to ensure their safety while training for, or playing in, a game of pickleball. The product is not designed for any other use. You are encouraged to seek the advice of a trained professional regarding proper pickleball training and playing techniques to avoid injury to you or others.

WE HEREBY DISCLAIM ALL WARRANTIES ARISING OUT OF THE SALE AND USE OF THE PRODUCT, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. BY USING THE PRODUCT, YOU HEREBY WAIVE ANY CLAIMS YOU MAY HAVE REGARDING LOSS OF PROPERTY OR PERSONAL INJURY, EVEN IF THE LOSS WAS DUE TO A MALFUNCTION OF THE PRODUCT.
